MiFlow General Booking Terms and Conditions

1. Provider, Scope and Contractual Documents
These General Booking Terms and Conditions apply to contracts for the paid provision of accommodation and related services by MiFlow. The contracting party is named under the Legal Notice, hereinafter referred to as “MiFlow”.
These Terms and Conditions apply to direct bookings made through the website, by email, by telephone or through other direct communication channels. For bookings made through external platforms, the booking-specific terms and conditions validly displayed on the respective platform also apply. Special conditions communicated before the contract is concluded may apply to retreats, groups, events and exclusive bookings of the entire property. The House Rules provided during the booking process form part of the accommodation contract. In the event of any conflict, the booking confirmation and any individually agreed terms shall take precedence over these Terms and Conditions and the House Rules.
2. Conclusion of the Contract and Electronic Bookings
The presentation of accommodation and services does not constitute a binding offer. By completing the booking process, the guest submits a binding offer to enter into a contract. The contract is concluded when MiFlow issues the booking confirmation. Before submitting the booking, the guest can review and correct the information entered. MiFlow will provide the booking confirmation and the terms applicable to the booking electronically and will store the contractual data in accordance with legal requirements. The guest must review the booking confirmation and notify MiFlow immediately of any apparent errors.
3. Guest Information, Occupancy and Transfer of Bookings
The person making the booking must be at least 18 years old and must provide complete and accurate information about themselves and all accompanying guests. The person making the booking is responsible for ensuring that all accompanying guests are aware of and comply with these Terms and Conditions and the House Rules. Only registered guests may stay overnight in the accommodation, and the maximum permitted occupancy must not be exceeded. Any changes to the number or identity of guests, as well as any visitors, require MiFlow’s prior approval. The booking may not be transferred, sublet, resold or commercially brokered without MiFlow’s prior written approval.
4. Services and Availability
The services included in the booking are determined by the service description, the selected rate and the booking confirmation. Minor variations in furniture, decoration or equipment are permitted, provided that they do not affect the essential characteristics of the accommodation or its use in accordance with the contract. Individual facilities or services may be temporarily restricted due to maintenance, repairs, weather conditions, hygiene requirements, safety concerns or official orders. MiFlow will inform guests of any significant known restrictions. Statutory rights in the event of a substantial impairment remain unaffected.
5. Prices, Taxes and Additional Services
The prices displayed and confirmed during the booking process apply. The total price includes the services and taxes expressly listed. The statutory tourist tax and any additional services requested after booking must be paid separately unless they are expressly included in the total price. Obvious pricing, transmission or input errors may be corrected. If the correction results in a higher price, the guest may reject the booking, in which case any payments already made will be refunded in full.
6. Payment, Credit Card and Security Deposit
Unless otherwise stated for the selected rate, 50% of the total price is due at the time of booking. The remaining balance is due no later than seven days before arrival. For bookings made within seven days of arrival, the total price is due immediately. Any different payment conditions applying to a flexible, non-refundable or other specific rate shall take precedence. If a payment fails, MiFlow may withdraw from the contract after informing the guest and allowing a reasonable additional payment period. Any agreed cancellation charges remain payable. MiFlow may request a valid payment method, the credit card used for the booking and proof of identity. MiFlow may also require a security deposit or credit card authorisation of EUR 300 per accommodation unit upon arrival. The security deposit or authorisation will be used solely to secure outstanding and verifiable claims, particularly in relation to additional services, damage, missing items, special cleaning or lost access devices. Any amounts not required will be released promptly after the accommodation has been inspected. Processing times imposed by the payment service provider may apply.
7. Check-in, Check-out and Guest Registration
Check-in is available from 3:00 p.m. Check-out must be completed by 11:00 a.m. Early check-in or late check-out is only possible with prior approval, subject to availability, and may incur an additional charge. Arrivals after 8:00 p.m. must be communicated to MiFlow in good time. Otherwise, access outside the regular arrival hours cannot be guaranteed. All guests must provide the legally required registration information completely and accurately. Guests aged 14 or over must confirm the official guest registration form in accordance with legal requirements. For younger guests, the accompanying adult must provide the required information. Official identification documents must be presented upon request. If the required registration is refused or cannot be completed, MiFlow may refuse to accommodate the guest. In the event of a late check-out, MiFlow may charge the reasonable costs incurred as a result. If the accommodation has to be blocked from further use, the charge shall not exceed the price of one additional night.
8. Cancellation by the Guest
Cancellations must be submitted in text form by email or through the booking platform used. The time at which the cancellation is received by MiFlow or the relevant platform is decisive. Unless different cancellation conditions apply to the selected rate, the following standard cancellation charges will apply: More than seven days before arrival: 50% of the total price Seven days or fewer before arrival: 100% of the total price Any expenses saved by MiFlow and any income received from re-letting the accommodation will be taken into account where required by law. The guest remains entitled to demonstrate that MiFlow suffered no loss or a substantially lower loss. MiFlow recommends taking out suitable travel and cancellation insurance.
9. No-show, Early Departure and Changes to a Booking
If the guest fails to arrive during the first booked night without providing timely notice, the booking will be treated as a no-show. In this case, MiFlow is not required to keep the accommodation available beyond the first booked night. The cancellation consequences set out in Section 8 will apply. In the event of a voluntary early departure, the cancellation principles set out in Section 8 will apply to the unused part of the stay. The guest has no automatic right to change or reschedule a booking. Requests for changes will be reviewed subject to availability and will only become effective once confirmed in writing. Price adjustments and reasonable processing fees communicated in advance may apply. Statutory rights relating to defects or deficiencies for which MiFlow is responsible remain unaffected.
10. Changes or Cancellation by MiFlow
MiFlow may only change or cancel a booking for good cause. This may apply in particular where: the accommodation cannot be used safely or in accordance with the contract due to unforeseen technical damage, fire, flooding, severe weather, an official order or comparable circumstances; the agreed price remains unpaid after an additional payment deadline has been granted; or material booking information is incorrect. MiFlow will inform the guest without undue delay and will make reasonable efforts to provide equivalent alternative accommodation under comparable conditions. The guest may reject a material change or alternative service. If no equivalent solution is available, any amounts paid for services that were not provided will be refunded. Any further statutory rights remain unaffected.
11. Force Majeure
In the event of extraordinary circumstances beyond the control of either party, the rights and obligations of both parties shall be governed by the applicable legal provisions. Both parties will make reasonable efforts to minimise the consequences and find an appropriate solution.
12. House Rules, Facilities and Termination of the Stay
The House Rules regulate, in particular, quiet hours, visitors, events, smoking, pets, the pool, wellness area, gym, safety, photography and video recording, Wi-Fi use and general conduct on the property. In accordance with the House Rules, the pool and wellness area may be used either in suitable swimwear or without clothing. The choices and privacy of other guests must be respected. The pool, gym, sauna, ice bath and any other facilities or activities may only be used in accordance with the House Rules, displayed notices, opening hours and safety instructions. Guests use these facilities at their own responsibility and must take their personal health condition into account. MiFlow’s statutory liability remains unaffected. In the event of a serious, dangerous, illegal or repeated breach of the rules, MiFlow may terminate the stay for good cause and require the person concerned to leave the property. Where the termination has been caused by the guest’s culpable conduct, the guest will generally not be entitled to a refund. Any expenses saved by MiFlow and the guest’s statutory consumer rights will be taken into account.
13. Children and Supervision
Children are welcome and must be included in the booking together with their ages. Parents and other responsible adults are responsible for supervising their children throughout the entire stay, particularly around the pool and in the fitness and wellness areas. MiFlow does not provide childcare or supervision. MiFlow’s statutory liability for breaches of its own obligations remains unaffected.
14. Guest Obligations and Damage
Guests must treat the accommodation and all facilities with care, observe all safety and hygiene instructions, report any apparent damage or malfunction immediately and refrain from using the accommodation for illegal purposes or purposes outside the scope of the contract. In accordance with applicable law, the guest is liable for any damage, loss or exceptional soiling culpably caused by the guest, accompanying guests or visitors. MiFlow may charge reasonable and verifiable costs for: repairs; replacement of damaged or missing items; special cleaning; damage caused by smoke or odours; lost keys, access cards or other access devices; technical call-outs; and demonstrable loss of use. Normal wear and tear will not be charged.
15. Defects and Complaints During the Stay
Any apparent defect, deficiency or disruption must be reported to MiFlow immediately so that the issue can be remedied within a reasonable period. If the guest fails to report an issue when it would have been reasonable to do so and MiFlow could otherwise have resolved it, the guest’s claims may be restricted in accordance with applicable law. Statutory rights relating to significant defects that are not remedied, or are not remedied within a reasonable period, remain unaffected.
16. Liability and Personal Belongings
MiFlow is liable in accordance with applicable law. Liability for death, personal injury or damage to health, intentional or negligent conduct and mandatory statutory liability is not excluded or limited. MiFlow is liable for the loss, theft or damage of personal belongings to the extent required by law. Valuable items must be stored securely, and any safes provided should be used. Any loss must be reported immediately.
17. Data Protection and Digital Services
Personal data is processed in accordance with applicable data protection laws and MiFlow’s separate Privacy Policy. Personal data may be processed in particular for: managing bookings; processing payments; registering guests; communicating with guests; and complying with legal obligations. Use of the Wi-Fi is additionally governed by the House Rules and applicable laws.
18. No Statutory Right of Withdrawal
Accommodation services booked for a specific date or period are generally not subject to a statutory 14-day right of withdrawal. Cancellations are governed by the selected rate, the booking confirmation and these Terms and Conditions.
19. Complaints and Dispute Resolution
Complaints may be submitted to: team@hotel-miamiplatja.com or sent to the postal address stated above. Official complaint and claims forms are available at the hotel. The guest’s right to contact the competent consumer protection authorities or recognised alternative dispute resolution bodies remains unaffected.
20. Applicable Law and Jurisdiction
Spanish law applies. Consumers will not lose the protection of mandatory provisions of the country in which they usually reside where such provisions are applicable under international private law. The statutory rules on jurisdiction apply to consumers. Where legally permitted, MiFlow’s registered office may be agreed as the place of jurisdiction for contracts with business customers.
21. Language, Amendments and Final Provisions
These Terms and Conditions may be provided in several languages. The version presented to the guest as the contractual version when the specific booking is concluded shall be the applicable version. Mandatory consumer rights remain unaffected. The version provided when the contract is concluded applies to the respective booking. Subsequent amendments will not apply retrospectively unless they have been expressly agreed or are exclusively in the guest’s favour. If any provision of these Terms and Conditions is wholly or partially invalid, the remaining provisions shall remain effective, provided that the contract can continue without the invalid provision. The invalid provision shall be replaced by the applicable statutory provisions.
